Making Money System

The result is a bunch of excess inventory and poorly thought-out construction projects which have no means of recouping the initial investment needed to repay the bank loans.

This practice is similar to Spain`s situation now where they have entire uninhabited building complexes that have yet to be marked to market, and will probably ultimately be demolished. But at least in Spain, even though it was a construction boom, it was engineered by developers in Spain, and not by some manufacturing outfits like those in China.

So, multiply the bad business project factor by ten and you get an understanding of the magnitude of bad loans on the books of Chinese banks. The problem is being further exacerbated by the practice similar to Spain`s of banks making additional loans to the businesses just so that they can then turnaround and pay back the interest owed on the original loans.

The only way this would work out is if these projects magically develop revenue streams. Unfortunately, in the case of Spain, a 20% unemployment rate, coupled with a still overvalued housing market in which prices still need to come down significantly, would suggest that by the time the Spanish economy recovers enough to support the excess inventory, the abandoned projects are run down and uninhabitable.

A similar scenario could play out in China as well.

True Smart Money Wary of the Write-off Domino 

Furthermore, China`s practice of overbuilding at the height of real estate valuations makes even haircuts on loan write-offs an untenable practice for banks, and by further throwing good money after bad, the ultimate mark- to-market effect could be catastrophic for Chinese Banks.

This is the main reason all the major Chinese banks have gone to the market in 2010 to raise more capital before investors wise up to the underlying deficits these banks face, as these bad loans eventually would need to be written off the books.

Victor Shih, a Northwestern University professor estimates that Chinese local governments borrowed some 11.4 trillion renminbi at the end of 2009, and that local government financing loans to be roughly one-third of China's 2009 GDP. 

Shih reckons the most likely scenario over the next few years is that there would be increases of non-performing loans ratio from local governments. This would require a large scale of recapitalization of the Chinese banking system, which would eat up a large share of China's foreign exchange reserves and possibly slow down growth.

I do believe Beijing is quite capable of  a few bailouts and surviving a widespread banking crisis, but this most definitely will not bode well for the financial markets.  That's most likely why you see insiders removing capital from direct exposure to the inevitable re-pricing that will happen throughout Chinese markets from real estate to the stock market. 

This can be seen at this early stage by the underperformance of the Chinese stock market compared to other global markets. Remember, foreigners cannot invest directly in these markets, so these capital outflows are truly the smart money.

Logistic Gridlock Crimping the Middle Class

Next let`s look at the recent news regarding a severe cutback in automobile registrations in Beijing to 240,000 in 2011 from 700,000 registered in 2010 by the municipal government. Other large cities in China are bound to follow. This is most likely related to the reported 9-day traffic jam on the Beijing-Tibet expressway in August, and other extended traffic jams throughout China in 2010.

China is trying to build infrastructure projects after the fact; whereas with proper central planning these should have been established far ahead of the massive transition from a rural, agricultural based populous to that of a modern, large city based business and manufacturing concentration.

Simply put, it is impossible for all the Chinese citizens who want and can afford automobiles to be able to own and utilize this form of transport without a total breakdown in the transportation system. We are seeing the early stages of complete and counterproductive gridlock in the transportation system of China, and it is only going to get worse over the next decade.

No Jobs for College Grads

For all the talk about how China graduates more engineers each year, and other college educated young people who have strong backgrounds in the hard sciences than most developed nations combined, this is actually another sign of problems to come over the next decade in China.

China`s wealth and emergence into the second largest business economy hasn`t been built around the need for these types of mind and skill set. So literally you have a large mismatch between the types of available jobs in China, that are supported by the heavy manufacturing and construction intensive focus of the past twenty years, to that of the recently educated pool of graduates who have grown in sizable numbers over the past five years.

The Mind Is A Terrible Thing To Waste

This results in a large human asset class that China is currently wasting, as most of the newly educated workforce is working in jobs which require little or no advanced education at the university level. So you have highly educated university graduates in areas like engineering and accounting working low level service and sales jobs that pay less than many manufacturing jobs.

In short, there are too many highly educated Chinese citizens graduating each year for the number of jobs available needing their skill set because China`s economic model isn`t built around these type of jobs. This type of misaligned employment outcomes never ends well; it usually manifests itself in increased civil and social unrest.

8% Inflation in 2011

The next major challenge for China is a skyrocketing inflation, which at its root is the fact that there are too many people chasing too few resources. This fundamental flaw in population dynamics underpins many of the problems that China faces going forward.

Recent CPI data for November illustrates the inflation problem in China with a reading of 5.1% from a year ago comparison, this is up from a 4.4% reading for the previous month. Couple this with the latest 4% hike in fuel prices in China because of rising oil prices, you could expect future CPI and PPI reports to reflect even higher rates of inflation.

For now, most of the year over year spike has revolved around higher food prices as energy has mainly been flat for 2010 thanks mostly to government subsidies. Now that energy prices have entered the picture, China will start to experience even more inflation pressures in 2011. 

Furthermore, with the undervalued yuan pegged to the dollar, it is only getting worse for China in 2011 due to Fed's QE2 pressures on the dollar.  The real inflation rate for Chinese citizens for 2011 will probably approach 8% next year.

An Asian Contagion by China?

This escalating inflation concern is further compounded by Beijing's lack of decisive action to combat the problem by delaying a much needed currency appreciation, and hiking interest rates in a timely fashion. There is no getting around the fact that these two things need to occur as soon as possible.

By the time the Chinese government is forced to implement these tightening tools, the damage to the economy is most likely already done. The longer China delays the inevitable serious tightening measures, the harder the economic crash that will occur in the aftermath of these policy changes. And it is unlikely to end well. The resultant impact will probably take the rest of the Asian economies down with it – an Asian Contagion scenario.

History Repeats Itself

Eventually central planners and finance ministers around the world might start to understand that policies which lead to bubbles being formed in the first place are counterproductive in the long run. But until that lesson is learned, it seems like we are doomed to repeat the same mistakes over and over again.

Right now, there are more and more signs coming out of China that all is not well with its economy, and the likelihood of a more severe downturn in the future is a distinct possibility, unless its policy makers take decisive and prudent actions to minimize the damage of a hard landing.

Florida will be playing in Tampa against Penn State while South Carolina will face Florida State in the Chick-fil-A Bowl (awarded to the SEC’s No. 5 finisher) and Mississippi State  (who beat Florida straight up and finished a game ahead overall) will play Michigan in the Gator Bowl (meant for the SEC’s No. 6 team).


Who cares that Florida was “less than Florida” this year.  We all know they’ll rebound, and it just seems more like a big game with them than without them.

Syracuse finished 2010 with at a better than expected 7-5 mark overall and went 4-3 in Big East play.  Regardless of how good this was it still puts the Orange a step below Pitt who finished (disappointingly) 7-5 overall and 5-2 in conference.


Regardless, Pitt has been shuffled southwards to the BBVA Compass Bowl (meant for the No. 5 Big East team) while the Orange will participate in the first-ever Pinstripe Bowl (hey, that’s played in New York isn’t it?) that is supposed to be awarded to the Big East’s No. 4 finisher.

No summary of 2010, visual or otherwise, would be complete without an extensive overview of what pundits call Monetary Stimulus, quantitative easing or Large Scale Asset Purchases, and the peasantry calls, just as correctly (with a few footnotes), the printing of money. If there are two words that define what we had an absence and an abundance of in the past year, those would be jobs, and money. As some of the key jobs-related charts were presented yesterday, below, once again courtesy of BusinessWeek, are the main charts that among other things demonstrate the various currency manipulation playbooks, the price of gas in bacon and other products, the annotated strength of the dollar through time, and what is actually printed when the Fed does print money.

The first chart shows the progression of dollar strength (and weakness) with an annotation for contemporaneous global events. What is ironic is that while everyone realizes the world is still in a very week position, the core debate over who is weaker - Europe or the US, is sure to provide many hours of entertainment in 2011. And as a bonus, the man whose policies, together with those of Bernanke, are instrumental in just how weak the dollar gets, is presented in his key natural states: from lying just every so slightly, to lying a lot, to lying profusely to save his life, to lying at such a rate, it would make those whose pants are burning, blush with envy. And now you will know how to distinguish the four... 

The next chart deals with the actual money printing, but not in an deeply philosophical manner, one in which hours of debate are wasted over whether trillions in excess reserves are actually printed money (even though the last time someone acquired USTs, MBS, and soon Munis and ETFs, with pixie dust, the legal consequences were not all that palatable). Of the just over $300 billion in actual currency printed in 2010, the vast majority was in $100 bills, next up was $20s, followed by $5s, $10s, and lastly, singles. Not a single $50 bill was printed. Also noted: the amount of cash in corporate America. Of particular interest: GM has more than half of its market value, or $27.5 billion sitting in cash. Lastly, and this not come as a surprise to many, the money multiplier: the money supply divided by the monetary base, is at near record lows, courtesy of the $1 trillion in excess reserves.

Another popular meme in 2010 was pricing X in Y, most often the stock market in gold, in which basis it is still down for the year, as gold (not to mention silver), despite the short memory of many, is by and far the best performing asset class of 2010. Those who followed our advice in early 2010 to avoid stocks and to invest in gold, are ahead of most. The chart below takes a comic approach to this relative performance, showing how much the price of gas changed when priced in other "currencies."

Last, and probably most interesting, is the graphic presentation of the currency manipulator playbook: in a world in which Ben Bernanke knows very well he has little competition when it comes to doing as he chooses with the world's reserve currency (for now), other sovereigns are forced to come up with their unique responses. The playbook below shows all the various defensive tactics adopted so far. Luckily, few offensive plays have been established to date. We doubt that will be the status quo for a long time.

And as John Taylor and many others have pointed out, now that the fiscal "stimulus" of the payroll tax has been exhausted in a few short weeks courtesy of the jump in crude oil, and any further fiscal intervention not likely to occur unless Congress wants another incumbent bloodbath next time around, as Americans are tired of subsidizing banker lifestyles, expect to see many additions to the FX manipulation playbook, as the year progresses and monetary intervention continues to be the only direct way of making sure every new banker bonus year is a record one is via the Fed and its ongoing dollar printing-cum-debasement. That said, should the bankrupt European house of cards continue to wave a white flag of surrender every 3 months, the race to the bottom may not have a clear winner well after 2011 is also history.

Bank Of America Lawsuits Highlight Broken, Ineffective Mortgage Modification Programs


The Attorneys General of Nevada and Arizona last week slapped Bank of America with lawsuits alleging widespread fraud occurrs in the bank’s mortgage modification programs. BofA, the nation’s biggest bank, has consistently lagged behind the other big mortgage servicers in successfully modifying mortgages for troubled borrowers. Andrew Jakabovics and I also caught the bank violating the contract it signed with Treasury to participate in the Home Affordable Modification Program (HAMP) by siphoning borrowers into its own private modification program without determining their HAMP eligibility.


But these lawsuits allege an even bigger mess, with BofA accused of giving deceptive and inaccurate reasons for rejecting modifications, and stringing borrowers along in the modification process for months, allowing them to continue making futile mortgage payments before ultimately foreclosing on them:


As a result of Bank of America’s misrepresentations, many Arizona consumers stopped making mortgage payments in a perilous attempt to qualify for help. Others waited for months for — or never received — answers on their modification requests, all while fearing that they would lose their homes; many actually lost their homes. Some consumers were misled to continue making payments in the belief that they would be able to obtain modifications and keep their homes.


Had they known they would lose their homes despite making payments, some consumers might have sough short sales or other foreclosure alternatives or simply allowed their homes to be foreclosed, saving the money from the additional payments for other necessary expenses. Other consumers lose willing buyers who could have mitigated their own (and Bank of America’s) financial losses by stepping in to purchase their homes.


Nevada’s attorney general told a very similar tale, accusing BofA of “misleading consumers with false assurances that their homes would not be foreclosed while their requests for modifications were pending, but sending foreclosure notices, scheduling auction dates, and even selling consumers’ homes while they waited for decisions.” The Upshot describes the “Boschian hell” that one Arizona family went through before having its home sold out from under it while waiting to see if it qualified for a modification.


Unfortunately, this story is all too common for homeowners seeking modifications. As Shahien Nasiripour noted today, 29,000 borrowers participating in HAMP have been stuck in the “trial modification” phase of the program for a year or more, unsure of whether they will ultimately keep their home, when that phase is only supposed to last three months. If those families are foreclosed upon in the end, they will have wasted months and months of payments that could have been used for something else.


HAMP, at this point, badly needs to fixed, and other foreclosure prevention efforts need to be undertaken. If they aren’t, the sorts of horror stories outlined above won’t stop, and the economy will continue to be weighed down by preventable foreclosures.

Iowa’s Attorney General Miller also agreed that principal reductions, loan modifications, and compensation for defrauded homeowners are all on his agenda


The lead Attorney General in the 50-state foreclosure investigation, Iowa’s Tom Miller, told homeowners at risk of foreclosure today that he supports a settlement with the big banks that requires significant principal rate reductions, loan modifications, compensation for citizens defrauded of their homes, and criminal prosecutions against big bank executives who broke the law.


“We will put people in jail,” Miller said, in response to questioning. “One of the main tools needs to be principal reductions, just like in the farm crisis in the 1980s…There should be some kind of compensation system for people who have been harmed…And the foreclosure process should stop while loan modifications begin. To have a race between foreclosures and modifications to see which happens first is insane.”


Attorney General Tom Miller met Tuesday with more than 100 people from 15 states representing community, faith, and labor organizations, foreclosure victims and struggling homeowners from across the country. Participants urged Tom Miller to make a strong settlement that includes loan modification and principal reduction as the primary tools for cleaning up the mortgage mess created by the banks.


Miller also agreed to continue to work with grassroots community, faith, and labor groups from across the country and agreed that the Bank Accountability Campaign’s members are stakeholders who deserve a seat at the table.


“We are very pleased with how this meeting turned out and now our expectations are higher than ever,” said Deacon Mike McCarthy, an Iowa Citizens for Community Improvement (Iowa CCI) member from Des Moines, IA.


“Attorney General Miller made it clear that he sees this investigation as a chance to clean up the foreclosure crisis that has ransacked our communities for over three years now and continues to push down housing values for everyone. He stated that loan modifications will be a core component in any settlement,” said Gina Gates, a foreclosure victim with PACT-PICO in San Jose, California.


“The stakes are high. A strong settlement is the best hope to hold Wall Street banks accountable and prevent millions more Americans from losing their homes,” said Mikael Broadway, from IAF in North Carolina.


“The big banks have repeatedly weakened efforts to get to the root of the foreclosure crisis,” said Shirley Broomfield, a struggling homeowner from Melbourne, Florida who is working two jobs to pay her mortgage. “They’ve failed to live up to their promises and outright ignored the rules of the game, with little to no consequences. The Attorneys General have a chance to change this.”


This is the first of a series of similar meetings with the state Attorneys General who are on the investigation’s executive committee. Participants in the meeting included borrowers who have lost their homes unjustly, other homeowners in danger of foreclosure, clergy and community advocates from 15 states – including Iowa, California, Illinois, Washington, New York, Colorado, Ohio, North Carolina, Florida, Missouri, Massachusetts, Kansas, Michigan, Montana and Oregon. The participants presented a stack of homeowner testimonies to Mr. Miller and made it clear that this investigation is their best hope for resetting the housing market and helping millions avoid foreclosure.


The group is staging protests this afternoon at the Wells Fargo Home Mortgage headquarters in West Des Moines and at branch of Bank of America in Des Moines to highlight the massive bonuses that bank executives will receive this month while millions of homeowners face foreclosure. They plan to lift up a new report showing that restoring equity to underwater homeowners would cost the big banks $73 billion, approximately one-half this year’s bonus & compensation pool. Similar protests will take place this week in New York and California.


The growing activity from homeowner groups comes amidst a turbulent time for big banks, especially Bank of America, with both investor lawsuits and the Attorneys General investigation pending, and some analysts beginning to predict the eventual need to restructure America’s largest bank in 2011.


The meeting with AG Miller and other events this week are organized by PICO National Network, National People’s Action, SEIU, Alliance of Californians for Community Empowerment, Alliance for a Just Society, and IAF Southeast.


Yves here. This is certainly good news, since the public can hold Miller’s feet to the fire if he fails to live up to these commitments. One concern I have is that the standard for fraud under the law, as opposed to from a common-sense perspective, is stringent, which means it is extremely difficult to prove. Remember Joe Cassano of AIG, the head of AIG’s financial products group? An investigation of him did not lead to prosecution, effectively because he has discussed what he was up to with AIG’s accountants. Fraud, as defined under the law, requires intent. So perversely, “I thought this was kosher” will get you out of a fraud charge.

how to budget personal finances




Automate Your Finances to Spend Less Time Managing Your Accounts





Despite how simple the process can be, most of us are terrible at saving and paying bills. Here's a strategy to effectively automate most of your finances to keep you saving and out of late fee trouble.

Ramit Sethi of I Will Teach You To Be Rich.com has put together a system for managing your personal finances that only takes about an hour of your time each week. The video above fully explains the process in detail, but here's the gist. First, you want to set up your bills and other payments so they're all happening on the day you get your first paycheck of the month (the first of the month for most people). Once you have that in place, you want to set up automatic savings plans (Sethi suggests using Ing Direct) with sub-savings accounts that let you organize your savings into specific categories (vacation, wedding, etc.). You'll also want to send a percentage of your paycheck to your 401k, and have all of this happen immediately so that the money you see when you get paid is the money left when everything has already been saved. From there, you automatically pay as many bills as you can with your credit card (and then pay the credit card bill on pay day). For the bills you can't pay with your credit card (like rent, in most cases), you can use your online banking to automatically issue a check. This will leave a little money leftover in your checking account that you can use to budget for guilt-free spending and cash withdrawals.


As someone who's often fallen victim to the faults of automatic payments systems (despite frequently using them), definitely do not forget to stay on top of your bills nonetheless. Make sure you set some time aside at least once a month to do a little maintenance and make sure there are no bugs causing your automated finance system to break down. Sethi isn't suggesting a set-it-and-forget-it automated finance system by any means, but as someone who hates paying bills I know how easy it can be to procrastinate and ignore the task. If you set up a good automated system like this one, you'll be at a point where all you have to do is watch and fix the occasional problem as the most important things are being taken care of for you.

That's how much money Ireland will be getting in the bailout package they said they didn't need as recently as Friday.  I just want to make it perfectly clear that I also DO NOT need a bailout of tens of Billions of dollars so whatever you do - DON'T give me a bailout this weekend.  Let's hope that works! The U.K. and Sweden may contribute bilateral loans, the EU said in a statement. Irish Finance Minister Lenihan declined to say how big the package will be, saying that it will be less than 100 billion euros but Goldman Sachs said yesterday the government needs 65 billion euros to fund itself for the next three years and 30 billion euros for the banks.  


Ireland's annual deficit is the worst in Europe at 30% of GDP (that would be like the US having a $5Tn annual deficit) and the nation is expected to slash its budget by $20Bn next year just to keep it under that level. Prime Minister Cowen holds a very thin majority and now faces a "no confidence" vote that could lead to further turmoil with a special election coming on Thursday for a vacant parliamentary seat.  "The likelihood of this government surviving long beyond the first month or two of next year is virtually gone now," says David Farrell, professor of politics at the University College Dublin.    


I already put out a special note to Members early this morning on the Dollar and the markets, so I won't get back into it here but suffice to say we are VERY concerned about any instability that may drive people back into the dollar. I also have nothing to say on the US Economy that John Mauldin didn't say in his great article this weekend "O Deflation, Where is Thy Sting?" so please read that and catch up on Market Tamer's very nice chart series and then we can move ahead with current events.  All caught up now?  Great, let's go!  


Also featured at PSW this weekend was Ed Harrison's note that perhaps some of the great Q3 performance in tech names was the result of good old-fashioned "channel stuffing," where companies inflate sales figures by forcing more products through a distribution channel than the channel is actually capable of ultimately selling.  In other words, be it the salespeople or the management trying to get better-looking results, they shove deliveries out the door in overly-optimistic anticipation of demand that is not likely to show up. This goes a long way to explain the discrepancy between reported sales and the lack of actual activity measure in the Baltic Dry Index (down 25% since early September) and rail traffic reports (flat).  


Even mighty German export growth is slowing according to the Ifo Economic Institute, which showed October's Export Climate index fell for the sixth consecutive month to 1.0, which is the lowest reading since last December. India is facing a mini crisis as micro-lenders begin to fail en masse and the S&P downgraded New Zealand to NEGATIVE on concerns over that country's finances. Keeping in mind that it's ALL about the Dollar (see note to Members) - the bulls should be VERY concerned about these developments.

Keep in mind that we are completing the Beta 3 as it's the up-trending pattern we've been following for months. If we begin to break down, that's going to be a different pattern and it's not likely to be driven and distorted by a "flash crash" like our May dip was although we can't discount the possibility and THAT'S WHY WE'RE BACK IN CASH!  I'm bored with saying it so you must be bored hearing it but I still see too many people asking "what's good to buy" when my answer is generally "nothing" at the moment.  If you think the above chart is depressing, take a look at this little piece of pattern recognition panic:



The big news in the US this week will be the "vast" insider trading probe of US markets that will, as usual, include our friends at Goldman Sachs.  US banks are looking at another $100Bn in potential mortgage losses, according to Barron's this week and, of course, China continues to try to flight inflation, which some estimate will move over 6% next year despite measures already in place.  


Keep an eye on copper $3.80, that's a canary in the coal mine for the global markets as is oil failing the $80 mark if it comes to that (now $81.67) but today is the last day of December contracts on the NYMEX and our bet is they dump off in the morning and climb back over $82.50 into inventories this week - as long as the Dollar stays below that 79 mark (now 78.67). We will get a lot of data for a short week with GDP and Existing Home Sales tomorrow morning and FOMC minutes, which are always fun, at 2pm.   Tuesday is all of the week's data stuffed into one day including oil inventories plus Mortgage Applications, Personal Income and Spending, PCE Prices, Durable Goods, Jobless Claims, Michigan Sentiment, New Home Sales and the FHFA Home Price Index.

The concept of race in today’s society is loaded with assumptions, political agendas, and unspoken emotional associations. According to philosophers, Bernasconi and Lott, it was first used in its modern form in 1685, by Francios Bernier. However, in the 17th century when the term was first emerging in intellectual discourse, ‘race’ had a variety of meanings; indeed, no one was committed to a specific definition. It was not until 1775 in his essay, Of the Different Races of Men, that Immanuel Kant gave the term its first explicit definition

The next question is “Can race be Biblically defined?” The term race does not appear in the Bible. The Bible refers to differing peoples in terms such as family, tribe, people and nation. It groups people according to familial relationships and then into nationalities. An example of familial relationship is found in Genesis 10, where the genealogies listed are grouped by family. It should be noted that nowhere are the sons of Noah associated with race or color. An important passage on this matter is found in Genesis 10:5:


“By these were the isles of the Gentiles divided in their lands; every one after his tongue, after their families, in their nations” (Gen. 10:5).


Note that familial and national division is shown, as well as division by geography and language (tongue). The significance of this will be discussed later in this paper. No where in the Bible is prejudice based on what we determine as race; i.e. color of hair, skin, eyes or physical characteristics. When God commanded the children of Israel to be a separated people or to utterly destroy other peoples, it was always based on the principle of separation from sin. The same principle of separation is presented in the New Testament when Christians are commanded to come out of the world and not be unequally yoked with the unsaved. (See 2 Cor. 6:14)

That article is just one more mind blower. Another completely innocent homeowner, coming out of bankruptcy yet CURRENT on her mortgage, is victimized by Countrywide/BOA in an attempt to fraudulently foreclose on her home by claiming the amounts she paid were incorrect and that her attorney had been notified 3 times that the amount had changed, but those three notifications were manufactured by a “low-level” Countrywide employee and only exposed when they used an address for one of the notifications that the attorneys did not move into until years later. Then, after being AWARE, that the notifications were forged, Countrywide/BOA did not inform anyone. The judge is so shocked by the behavior that he addresses it as a warning to other courts and judges, even though it is not even a point of contention. This story is a great one to bookmark and send to people who continue to believe that this whole thing is just some “deadbeats” trying to pull a fast one on the banks when in fact, it is the very opposite.

Even more interesting, and I have noticed this on every single foreclosure fraud story I have ever read in any newspaper, are the number of completely bizarre comments concerning the story (the whole point of which is the homeowner’s INNOCENCE) about “throw the deadbeats out”. The people making those comments can’t have read the story or if they did, they just do not care about the content.
